Booking Terms & Conditions

Any reference to us, we, proprietors or owners in these booking terms and conditions refers to Vomero Holiday Apartments. You, your, guest or lead booker are references to the person making the booking and all members of their holiday party. Nothing in these conditions affects your normal statutory rights.

Please read the terms and conditions of booking below, these are the conditions on which your booking is made.

Your Booking

You must be at least 18 years old to make a booking at Vomero Holiday Apartments. Bookings are to made directly via our website using our Freetobook booking system. Any disputes or queries will be between the lead booker and the owners. As lead booker you will assume responsibility for the compliance of these rules by all of your holiday party. We reserve the right to accept or refuse bookings without reason and have the right to cancel any booking prior to the issue of written confirmation. If your booking is not accepted we will inform you in writing and refund any monies you have paid to us. When your booking confirmation is received please check all details, if anything is incorrect you should advise us immediately.

Number of Occupants

The number of guests occupying your holiday apartment must not exceed the maximum number stipulated in our property descriptions; Roma, Venezia and Vomero maximum occupancy of 2 guests, Napoli, Genova and The Penthouse maximum occupancy of 4 guests. (Our Venezia and Genova apartments on approval can accommodate extra children under 10 years, two in Venezia and one in Genova.) The Penthouse is strictly adult only due to the location of the accommodation.

We reserve the right to refuse entry to the entire party if this condition is not observed. This must be adhered to and before your booking is confirmed, the lead booker who made the booking must complete the Guest Booking Form, to include all guests names and ages of any children. Parties must not exceed the numbers specified and the owner reserves the right to ask customers to vacate if this is abused. Please ensure that the apartment accommodation you book meets your requirements.

The accommodation shall only be used by the persons named on the booking form and must not be sub-let. Please advise the proprietor of any guest visitors during your stay, visitors must be signed in on arrival.

We do not accept single sex groups, Hen and Stag parties, large groups and booking for trades persons, failure to disclose this at the point of booking will make the booking invalid.

Paying for your accommodation

A non-refundable deposit of 25% of the total booking price is payable immediately, at this point your booking becomes binding and the lead booker is responsible for the full balance of the cost of the holiday. The balance of the booking must be received no later than one month before your arrival date. We reserve the right to cancel the booking if full payment has not been received four weeks prior to your arrival. If you book less than one month before your arrival date, payment of the total cost is due immediately. Our website booking system now takes credit card payments but we do still take payment by bank transfer if preferred. Cheques are also accepted and must be cleared four weeks before your stay.

Cancellation of booking by you (not including OTA bookings – see below)

We do understand there are circumstances when cancellations are required. If you need to cancel or transfer your booking, you must contact us as soon as possible by email.

The 25% booking deposit is a legal contract and non-refundable. Cancellation within fourteen days of your arrival your balance is non-refundable.

However, we will make every effort to re-let the property once formal written cancellation has been received. If we are able to re-let at the same price for the same dates, any deposit and balance paid will be refunded subject to administration charges and price differences.

It is your responsibility and we strongly recommend that you take out holiday insurance against cancellation due to adverse weather (and your inability to reach the property), ill-health or bereavement etc.

Cancellation of booking by us / Disruption to your stay

We have the right to cancel your booking in advance and you will be refunded the full amount of the booking. We would only cancel your holiday if your accommodation was unavailable (‘unavailability’ does not extend to your inability to reach the property, due to adverse weather for example) for reasons beyond our control. In this circumstance, we would refund all monies paid by you for the holiday. Our liability would not extend beyond this refund. Except where otherwise expressly stated in these conditions, Vomero Holiday Apartments shall not be liable for any changes, cancellations, effect on your holiday, loss or damage suffered by you or for any failure by Vomero Holiday Apartments to properly perform any of their respective obligations to you which is due to any event(s) or circumstance(s) beyond the reasonable control of Vomero Holiday Apartments (i.e. ‘force majeure’). By way of example, force majeure includes fire, flood, power grid supply issues, exceptional weather conditions (i.e. your inability to reach the property due to snow), epidemics, destruction or damage of the property by any cause (other than negligence of Vomero Holiday Apartments) and all similar situations, whilst these situations are very rare, they can happen and affect everyone.

Damage to property and Damage Deposit

You are responsible to the owner for the actual costs of any breakage or damage within or to the accommodation, along with any additional costs that may result, which are caused by you or your party. At Vomero Holiday Apartments we chose not to take a damage deposit therefore you are expected to report any breakages or damage to the owners immediately. No repairs of any kind to the property or contents must be attempted by you or your party. Please let us know about any problem with any appliance or fixture or fitting as soon as possible and we will ensure that, within a reasonable time, this is repaired or alternative arrangements are made.

If you are booking your stay at Vomero Holiday Apartments via an OTA, you are bound by their Terms & Conditions for the booking process, payment collections and timescales, and cancellation process only. Our house rules and all other terms within this document are valid for everyone who stays at Vomero Holiday Apartments, regardless of who you book your holiday with.

By booking via an OTA, i.e. Booking.com, Airbnb or VRBO you pay additional fees for 24/7 help and guidance, more flexibility around cancellation and deposit payment etc.

For our very best prices we always recommend booking direct with Vomero Holiday Apartments.

Accidents, injury, and personal property

The owners shall have no liability to you for the death or personal injury to you or any member of your party. Visitors are asked to take care at all times whilst on our property. Parents in particular are asked to ensure that children are safe, accompanied by a responsible adult and not left unattended. We do not accept responsibility or liability for injury or damage to and loss of guests property, cars and contents and you agree to indemnify and hold us harmless from and against all actions, claims, costs and proceedings (including reasonable legal fees incurred in defending the same) arising from your acts or omissions (and those within your party) while on our property. In the event of guest misbehaviour or other necessary cause, we reserve the right to terminate the let without any refund of letting monies.

Website and advertisements

The owners aim to ensure that the information and descriptions provided are accurately conveyed on their official website, www.vomero.co.uk and any authorised third-party or advertisements. There may be small differences between the actual accommodation and its description as we are always seeking to improve services and facilities. Occasionally, problems mean that some facilities or services become unavailable, and if this is the case, we will tell you as soon as reasonably practical after we have been made aware of the situation. Similarly, we cannot accept responsibility for any changes or closures to local area amenities or attractions mentioned on the website or advertised elsewhere.

Arrival and departure

Your accommodation will be available to you after 5 pm on the start date of your holiday, please advise us in advance if you expect to arrive late. Please vacate your apartment by 9.30 am on your day of departure to allow for our changeover and cleaning prior to our next guests. The period before and after your stay is probably booked by other guests, so please respect our check in and departure times so we have enough time to prepare for our next guests (the result of your late departure could incur charges as a result of housekeeping staff being prevented from accessing the property at the agreed departure time).

You must allow the owner or any representative of the owner access to the property at any reasonable time during your stay. Your right to occupy the property is limited to a right of occupation for holiday purposes only and such right shall terminate at 9.30 am on the scheduled date of the completion of the holiday.

Parking is available with one no-allocated parking space per apartment; please check prior to bringing additional cars, although on road parking is available a short walk away in either Lower Warberry Road, or Hunsdon Road.

If you arrive in Torquay earlier than check-in you are more than welcome to park up at Vomero Holiday Apartments and have a walk down into town. Please do advise us with your name, apartment, registration plate and mobile number so we are able to text you if your apartment is available any sooner.

Bed linen and towels

Bedlinen and towels are provided on arrival and are included in the price of your holiday.

If you are staying at Vomero Holiday Apartments for additional weeks, we will provide you with the weekly option of a full set of linens for all beds and fresh towels for each guest. These will be provided for guests to complete the changeover and return used linens and towels in the bag provided.

Cleaning on departure

Please leave your apartment as found, in a clean and tidy condition, we would kindly ask you to:

Strip and put all used bed linens (except pillow and mattress protectors), towels, bath mats and teacloths in the blue bag provided outside your apartment the evening prior to departure.

Empty all bins and put all securely tied rubbish in the blue commercial bin in the rear carpark.

Remove any opened and perishable food from the fridge.

Leave some windows open for ventilation and leave apartment keys in the apartment front door.

Please put any furniture back as you found it.

We do not charge a cleaning fee so would request you leave the apartment clean prior to departure.

We reserve the right to make a charge if the apartment is left in an excessively dirty condition.

Your responsibilities

For the whole period included within your booking, you will be responsible for the property and will be expected to take all reasonable care of it.

Smoking

Within Vomero Holiday Apartments house and apartments, smoking and vaping is strictly prohibited. We reserve the right to seek compensation (including consequential loss) for any damage and additional costs of cleaning or fire alarm activations caused by a guest smoking inside the property. Consequential costs may be incurred where it is not possible to remove the smell of smoke from the property prior to the arrival of the next quest who subsequently demands compensation from us. Note we also do not permit the use of candles or naked flames, both from a fire risk point of view and to avoid any alarm activations that may result in the call out of the fire service.

Outside Vomero Holiday Apartments within the gardens you are free to smoke. Please dispose of your cigarette butts and ash responsibly and not on the floor areas.

Amenities

The use of the amenities, i.e. bbq, garden chairs and tables, outdoor games etc. is entirely at the users’ risk and no responsibility can be accepted for injury, or loss or damage to users, or guests’ belongings. Please ensure you seek advice on how to use these items safely if in doubt. Please feel free to use any games/small toys but it is your responsibility to ensure you use them properly and do not leave young children unsupervised.

Fireworks / Outdoor music / Quiet hours

Use of fireworks or lanterns is not permitted under any circumstances at any time. Please refrain from playing music outside too loud and after 10pm. We want you to enjoy yourselves and relax but please respect other guests and neighbours.

In the interest of other guests please ensure there are no unreasonable amounts of noise within the apartment and communal areas. Please pay special attention to this between the hours of 11pm and 8am and respect other guests quieter hours.

Problems & Complaints

Every effort has been made to ensure that you have an enjoyable and memorable holiday. If however, you have any problem or cause for complaint it is essential that you contact us immediately on 07738093879 to give us the opportunity to resolve it. It is important that this is done whilst you are still at the property so that an on-the-spot investigation can be made if necessary and remedial action taken if required.

In no circumstances will compensation be considered for complaints raised after the holiday has ended. We value your custom and want you to return.

Lost Property

Please contact us as soon as possible if you think you have left any personal items in a property after your departure. Should you wish your items to be returned, we will happily do so but the postage must be paid in advance by you. In the event of us finding any property, we will contact you and if we have not had a response from you within 28 days, we will dispose of the item, based on their condition, as we see fit.

Data

All electronic data transferred pursuant to these terms and conditions remains the property of the owners or their agents and may not be replicated in part or whole without the owners’ prior written permission. Electronic data will not be preserved indefinitely by the owners.

Changes to Terms

We may revise these terms from time to time.

If we revise these terms prior to your arrival date, we will email you with a new copy. You can choose to cancel the booking agreement, if any new terms are no longer suitable to you.

Rights

Vomero Holiday Apartments may transfer their rights and obligations under these terms to another organisation and will notify you in writing if this happens but this will not affect your rights or Vomero Holiday Apartments obligations under these terms.

Breach of Contract

If there is a breach of any of these clauses by the Guest or any of their party, the Owners reserves the right to re-enter the property and end the holiday and ask the Guest and their party to leave.

If there is a breach of any of these conditions by the Owners, then the Guests have the right to end the holiday and leave.

Ending the holiday by the Owner or the Guest does not affect that party’s other rights and remedies.

Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in force.

Validity Clause

If any term or provision in these booking terms and conditions is found by any court, tribunal or administrative body or competent jurisdiction to be wholly or partly illegal, invalid, void, voidable, unenforceable or unreasonable it shall to the extent of such illegality, invalidity, voidness or unreasonableness be deemed to be severable and the remaining provisions of the booking conditions and the remainder of such provision shall continue in full force and effect.

Jurisdiction and Governing Law

These terms and governed by English Law. You agree to submit to non-exclusive jurisdiction of the English Courts. However, if you are a resident of Northern Ireland, you may also bring proceedings in Northern Ireland and if you are a resident in Scotland you may also bring proceedings in Scotland.

Please note that these booking conditions supersede all previous issues.
